Three Arms

Vanderboob is up to his shameful old tricks again……………………………..

http://iiipercent.blogspot.com/2013/10/when-person-shows-you-who-he-is-believe.html

I have been around the block or two, I have met many men just like Mikey. I would have to say his latest move was not his brightest, sadly justice will prevail and the owners of Three Arms will move on.

There is a pervasive evil amongst our ranks, we have all seen it. I rant and I rail about the duplicity in our community, this is quite simple.

“A trademark is a brand name.  A trademark or service mark includes any word,
name, symbol, device, or any combination, used or intended to be used to
identify and distinguish the goods/services of one seller or provider from those
of others, and to indicate the source of the goods/services.  Although federal
registration of a mark is not mandatory, it has several advantages, including
notice to the public of the registrant’s claim of ownership of the mark, legal
presumption of ownership nationwide, and exclusive right to use the mark on or
in connection with the goods/services listed in the registration.”

This will not be the first time in the history of America that some clown will get his pants sued off of him for Trade Mark Infringement, yet I must say they will probably be very deserving. This was not accident or a opsey……. I had to idea I am sorry. These actions are meant to HARM and destroy the hard work of many fine patriots.

There is no need to get into the nuances as to why Mikey is doing this…….. we all know why.

The Merry Leader has been at this game for what?………. 30 plus years? What has he actually accomplished other than keeping the community divided? His selfishness has retarded the community.

Many have asked…. and we still do. Mike who do you work for? We have all seen first hand how the community has grown in leaps and bounds in the last few years, this is why the Merry Leader is so ate up with poison. There are fine folks doing great things for the community.

I will offer this recent quote from the Dear Leader………………………….

“Kerodin and his thug band need to get a life.  In any case, their conduct shows that it is money not principle that motivates them.”

I have to wonder if the Dear leader Feels the same about his compatriots over at Oath Keepers? Last time I checked………………………………….

oathkeepers

No the dear Leader is confused once again. We could discuss the money the Dear Leader begs for on his site. Duplicity……………………

contradictory doubleness of thought, speech, or action; especially    :  the belying of one’s true intentions by deceptive words or action

I don’t think this latest move will politically work out the way the Dear Leader thinks it will. It has already backfired, Mikey has been greatly harmed by this. I would venture to say it could be a mortal wound.

I would like to discuss one last point, Three Arms has been cordial enough to ask yet again for Red Dot to cease prior to sicking the lawyers. This is very important, it demonstrates the quality of the folks who own Three Arms.

  1. I just left the asshole a nice, friendly comment on his page. I’m sure he won’t have the balls to publish it though. It breaks his black heart knowing how much more K has done for the III and actually had tangible results, same as you with the seed business. It kills him that you guys are doing more than just telling people to throw bricks. He claims that you guys are only in it for the money but at least you guys are offering goods and services for your money instead of thinking your “3 or 4″subscribers should pay you for your knowledge.

  2. I have left several comments on his page pertaining to this matter. I was polite and courteous in all of them. What I have gotten in response was the rantings of someone who appears to be losing his mind; schoolyard rants and name calling against S Kerodin; statements of a double standard nature pertaining to the past behaviors of his own and Mr Kerodin.

As I stated on his page, it is sad watching the childish idiocy on display. And yet MVB “claims” it is not about ego, but about principle. Me thinks he needs a dictionary because it appears he does not know the definition of either word.

  3. I guarantee that I’m not in it for the money. Those who have ties to this project KNOW what I am in it for. Profit is NOT on that list. For me, I have no illusions that I’ll become rich off this. But the cause moves towards our goal with every sale. That goal, and that movement towards it, is what pisses more people off than anything else. WE are doing something, very few others can claim that has happened on their watch.

Hmmm. Maybe that’s the OK promise and how it mirrors MVB? Progress and Unity: Not On Our Watch.

    • Mr Miller once I/we have the money, you and III Arms can be certain that there will be at least one, but probably two (wife likes to keep things in matched pairs) of these fine AR’s purchased.

To hell with the dividers and antagonists, they only find happiness in their own jealousy and anger.

      • Mr. Ford, I read your comments on his site and I will say you showed nothing but class even with him firing back at you with nothing but hate and anger. You, sir, are the kind of person the III is all about.

  4. Mike invented “III” before either K or Miller showed up, so if anyone owns the copyright, it’s Vanderboegh.

Here’s a pre-K posting for you (there are plenty of others from 2009):

“III Arms” is a trademark, III by itself is not. The Red Dot folks aren’t going to lose any sleep over this. You don’t see the Colt folks running around suing everyone over “AR-15”, and their claim is much stronger.

Speaking of, I did a search on the Fed database, TESS. No “III Arms”. No “III” either, but that might be an error in my search-fu.

    • Sorry Peter – you need to look at the very simply Mark that was registered and accepted – it is the Roman Numeral III, in any font or size, as regards any firearm or firearm accessory. “Arms” doesn’t play into the mark, at all. Learn the topic before you pontificate, so it looks less like defecate.

      • OK, Sam. I’m not at all well versed in this, so you might be right. I did look around and I didn’t find anything, and as I said, that could be because I didn’t input the right search terms.

My sense is that a Roman numeral is too generic for a trade/service mark, but I’m not a lawyer either. Fine. And what’s not debatable is that Vanderboegh came up with ‘III’, so sorting this all out might not be as straightforward as you might think.

This, in the end, is at least somewhat sparkly. Don’t let it distract you from your other projects.

    • It is a “trade mark” not a copyright. Oh, and you are absolutely wrong when you state MVB “owns” it. To legally own the trade mark one must file it and receive “approval” at the Patent Office, MVB did no such thing. Oh, additionally for your information, Patents, Trade Marks and Copyrights fall under Constitutional Law.

      • Peter…………..My wife has been in the IP field for well over 30 (thirty) years. As pertains to the “Trade Mark” in question, Mr Kerodin is absolutely correct in what he has stated. You are also confusing a “Patent” on a product; Armalite/Colt AR style rifles with a Trade Mark of a company. They are entirely different and follow different “rules”. A patented “product/item” has a time frame allocated (which expires after a certain time) where no one, unless incensed by the original inventor(s), may manufacture the same product. This is much different than the rules pertaining to Trade Marks. A better analogy would be another Company opening and operating under the Colt name/Trade Mark. Yeah, see how far that goes.

          • Peter………thank you for the polite reply. It appears that in regards to all of this idiotic, egotistical BS, you appear to be able to remain civil.

While you are correct in your statement that the Roman numeral III in of itself probably is too generic to apply a Trade Mark. However in this case it has been directly associated with a firearm. Therein lies the crux of the matter.

Oh, and yes, this is one of those “sparkly” things Bill talks about. Our enemies are probably throwing a party at all the horseshit we distract ourselves with, as opposed to “burying” them forever so they can never attempt to destroy our Republic in the future.

Once again, Thank You very much for the “cool head” and polite reply.

Stay safe, watch your 6, and in the end; may we who have much more in common than; not destroy and bury our common “enemies”, once and for all.
